General Terms and Conditions
The deinweinkuehlschrank.de online shop is operated by Cavanet Wineworld, S.L., Marqués de la Valdavia 97, E - 28100 Madrid (hereinafter referred to as "Cavanet"). Orders and contracts from customers and deliveries to customers for products from the online shop are exclusively carried out according to the following General Terms and Conditions (hereinafter referred to as "GTC").
Conclusion of Contract
The presentation of goods in the online shop does not constitute a legally binding offer to conclude a purchase contract, but an invitation to place an order with Cavanet.
The following technical steps lead to the conclusion of the contract:
The customer can place the goods presented on the product pages in the shopping cart by clicking the "Add to Cart" button.
When the customer goes to the shopping cart by clicking the appropriately named button "Checkout" and then clicks the "Pay Now" button at the end of the online order form, the customer submits a legally binding offer to conclude a purchase contract for the products placed in the shopping cart. Any input errors can be corrected in the shopping cart by changing the number of items or deleting items altogether by clicking the "Remove" button before proceeding to checkout.
The customer will promptly receive an order confirmation via email. This order confirmation confirms the receipt of the customer's order by Cavanet and lists the details of the order, such as the ordered products, prices, shipping, and further details. It does not constitute acceptance of the customer's offer. A purchase contract is only concluded when the customer receives confirmation of the shipment of the products in a further message (shipping confirmation or order confirmation).
Payment Terms / Retention of Title
Customers can pay the purchase price by credit card, immediate transfer, or PayPal. The shipping and billing address must be in the Federal Republic of Germany. The products remain the property of Cavanet until full payment has been made.
Prices / Transfer of Risk
All prices include statutory VAT plus the respective shipping costs. The risk passes to the customer upon delivery of the products.
Warranty / Liability
If the customer identifies any defects in the delivered goods, such as obvious transport damage, they must report these immediately to the logistics partner or Cavanet. Failure to report does not affect the customer's statutory rights unless the purchase is a commercial transaction for both parties and the customer has a duty to inspect and report defects according to § 377 HGB. By reporting defects promptly, the customer allows Cavanet to assert its own claims against the logistics partner or transport insurance.
Cavanet is fully liable for intent and gross negligence, but only for slight negligence in the event of a breach of essential contractual obligations. Essential contractual obligations are those obligations that protect the customer's fundamental legal positions, which the contract is intended to grant according to its content and purpose; essential are also those contractual obligations whose fulfillment makes the proper execution of the contract possible in the first place and on whose compliance the customer regularly relies and may rely. Liability for breach of such essential contractual obligations is limited to the typical contractual damage that Cavanet had to expect at the time of contract conclusion based on the circumstances known at that time. This does not affect liability for delay. Cavanet assumes no liability for disruptions within the network that are not its fault. Cavanet is liable for data loss only according to the above provisions if such loss could not have been avoided by appropriate data security measures on the part of the customer. Liability does not extend to impairments of the contractual use of the services provided by Cavanet in the deinweinkuehlschrank.de online shop, which are caused by improper or incorrect use by the customer.
Warranty Conditions
Manufacturers provide a 2-year warranty on goods advertised with the voluntary warranty promise. The period for calculating the warranty duration begins on the invoice date.
In the event of a warranty claim, please contact the respective manufacturer/warranty provider.
To apply for the warranty service, you must provide proof of purchase to the warranty provider upon request (e.g., by enclosing a copy of the original invoice of the shipped goods). Please understand that the manufacturer may refuse the warranty service if proof of purchase is not provided, as it serves to calculate the warranty period.
Applicable Law
The law of the Federal Republic of Germany applies.
Dispute Resolution
The European Commission provides a platform for online dispute resolution at http://ec.europa.eu/consumers/odr/. Cavanet is not obliged and not willing to participate in a dispute resolution procedure before a consumer arbitration board.
